Application fees and rents

What’s the difference between a licence application fee and annual rent?

Holders of leases, licences and permits that occupy Crown land are required to pay rent. The individual tenure agreements contain provisions for the periodic market redetermination of rent.

Lease application

The application fee represents an advance towards processing costs. Following receipt and assessment of the application the following costs will also be payable where applicable:

  • site investigation
  • land assessment - advertising (newspaper and gazette)
  • assessment of natural resource management implications and Part 5 EPA Act requirements
  • survey/plan compilation
  • valuation
  • publication of notice of intention to lease
  • negotiation/re-processing draft lease document

Roads

Crown road purchase application

The fee covers costs for the road status and tenure searches and consultation undertaken by the department and for advertising the proposal in a local newspaper and the status and search undertaken by the department. The application fee is not a deposit or an advance on the purchase of the road.

Rents

Rents are paid annually for licences and leases over 12 months and redetermined every 3 years.

For licences less than 12 months, rents are paid as a one-time annual payment.

The rent for tenures is determined by one of the following methods:

  • market rent reviews for most tenures
  • IPART market rent reviews for domestic waterfront licenses
  • ministerial direction for enclosure permits
  • statutory formulae for Western Land leases

Rebates

Rebates from market rent can be granted for tenure holders that meet defined eligibility criteria. This includes pensioners, charitable or non-profit community service, sporting or cultural organisations, however the rent will not fall below minimum charge.
