Apply for a water boundary determination (non-tidal)

Before you apply

Non-tidal waterways, including rivers, creeks, and lakes, adjoin property across NSW. Many non-tidal waterbodies are Crown land. For a non-tidal water determination, ensure you determine whether Ad Medium Filum Aqua exists and if we are the adjoining owner. Approval can be provided for the following situations if we are the adjoining owner:

  1. First non-tidal bank boundary definition - s75(2)(a) SSIR 2024
  2. First non-tidal middle thread boundary definition - s75(2)(a) SSIR 2024
  3. Changed non-tidal boundary

Supporting documentation

The following supporting documentation is required as part of the application form and prescribed fee:

  • confirm that the subject lands is upstream of tidal limits (non–tidal)
  • confirm the Crown is the adjoining owner (Check Ad Medium Filum Aquae).

Application fee

We will send you an invoice for any fees after we receive your application. Once you pay the application fee, we will process your application.

Fees are non-refundable if we are not the adjoining owner.
