Western Lands leases in NSW can either be perpetual or for a term of years. Perpetual leases continue indefinitely, while term leases have a set duration. If your term lease is due to expire, you may apply to extend the term or convert it to a perpetual lease. We will contact leaseholders 2 years prior to expiry with options for consideration.
Extension of term
If your Western lands lease is for a term of years and is nearing expiration, you can apply to extend the term. This application must be submitted by the registered leaseholder or an authorised person. The extension can be for a further term of years, but the cumulative term must not exceed 40 years.
Conversion to perpetuity
Leases granted for a term of years can be converted to perpetuity if the original term, including any extensions, has not exceeded 40 years. This process involves submitting an application. Once approved, the lease will continue indefinitely.
