Apply for a new lease online application form

Before you apply

  1. Determine the appropriate cloud service e.g. Google Drive, Dropbox or OneDrive to provide a direct download link to the Department to share all required supporting documentation.
  2. Prepare the supporting documents you may have to support your online application form.
  3. A Crown Land Lease - proposed lease holder/s consent form (PDF 141 KB) signed by all applicants.

Supporting documentation

You must supply the following mandatory supporting documentation –

  • site plans and layout
  • tax returns and statements of net worth for the past three financial years for each relevant person
  • annual reports including profit and loss statements and balance sheets for the past three years
  • other records confirming current financial status and financial performance for the past three years
  • statements from financiers confirming finance arrangements, which may include evidence of a lender’s commitment to fund capital works including the proposed split of debt and equity
  • details of significant events, including pending litigation, that may impact on capacity to implement the plan
  • details of past projects demonstrating relevant experience
  • two referee statements attesting to the business capability and experience of the applicant(s)
  • images of business premises
  • statement supporting the application for lease by direct negotiation
  • two forms of identification documents for each applicant signatory and for each individual business partner and / or each office bearer of each applicant company, trust, incorporated association or government agency that is party to this application
  • Additional supporting documentation may be required depending on the specifics of your application.  You will be prompted throughout the form to add the required documentation to your download link.

Next steps

  • Once your application is accepted, you will be invoiced for the Lease application fee. Refer to Fees. There may be additional fees charged in the assessment process.

Proof of identity is required for each applicant signatory to this application and for each individual business partner and / or each office bearer of each applicant company, trust, incorporated association or government agency that is party to this application.

If you hold an existing Crown holding and the land has existing infrastructure and/or improvements (including Tenants Fixtures) a building inspection report is required.


The report must accord with appropriate sections of the Australian Standards (as amended from time to time), be prepared by a suitably qualified and experienced consultant, and include the following:


(a) identification of all repairs required (including detailed photographic log)

(b) identification of whether the repairs required are a result of fair wear and tear or default/misconduct

Applicants are to provide evidence of their skills, qualifications and work experience.


Section 5 - Lease by direct negotiation

As a general principle, the Department will use competitive processes for the lease of Crown land. However, there are circumstances where it may not be possible or practical to use a competitive process.

Any application for a lease of Crown land by direct negotiation will need to consider the NSW DPE Crown land Policy IND- O-182 Sale or Lease of Crown land by direct negotiation 2016. The policy sets out the framework by which the Department will consider entering into direct negotiations for the lease of Crown land.
