Only Perpetual Western land leases are eligible for subdivision.
Subdivision of a Western lands lease is often necessary when a lessee wants to:
- sell part of the lease
- change the purpose of part of the lease
- divide leasehold lands for estate planning or other reasons.
Required approvals
Before subdividing a lease, you must obtain approval from the Minister. Additionally, landowner’s consent is required from Crown Lands and lodged in conjunction with the development application with council. Development consent from the local council is required for all subdivisions outside of the unincorporated area of NSW.
Subdivision process

Initial steps
Determine if the subdivision follows existing parcel boundaries. If it does, a survey may not be needed.
If the subdivision does not follow existing boundaries, a survey will be required.

Development application
For Crown land, any development application must first be authorised for lodgement by us, as the landowner.

New leases
Upon subdivision, new leases are created for each area excised out of the original holding.
Alterations of a Western lands lease
In addition to subdivision, lessees may also seek to alter their Western lands lease. This can include changes to the lease terms, boundaries, or purpose. Approval from the Minister and possibly local council consent will be required for any alterations.
