Minister's consent to transfer a Crown land lease by assignment or change of control

Before you apply

  1. This application must be submitted by the current leaseholder or a person authorised to submit on their behalf.
  2. Determine the appropriate cloud service e.g. Google Drive, Dropbox or OneDrive to provide a direct download link to the Department to share all required supporting documentation.
  3. Prepare the supporting documents you may have to support your online application form.

Supporting documentation

You must supply the following mandatory supporting documentation:

  • A Ministers consent to transfer a Crown Land Lease by assignment or control consent form (PDF, 151 KB) signed by all the leaseholders.
  • A certified copy of all contracts for the transfer of the lease, sale of the business, transfer of capital or any other associated agreement to be assigned in addition to the lease
  • Evidence of public liability insurance
  • Two referee statements attesting to the business capability and experience of the future leaseholder(s)
  • Evidence of the future leaseholder's financial capacity, which may include evidence of a lender’s commitment to fund capital works including the proposed split of debt and equity
  • Evidence of the future leaseholder's financial capacity, which may include evidence of a lender’s commitment to fund capital works including the proposed split of debt and equity
  • Two forms of identification documents for each future leaseholder signatory and for each individual business partner and / or each office bearer of each applicant company, trust, incorporated association or government agency that is party to this application

Next steps

  • Once your application is accepted, you will be invoiced for Minister's consent application fee. Refer to Fees.  There may be additional fees charged in the assessment process.
  • A deed of consent and assignment is required between the current leaseholder, the future leaseholder and the Department to capture the obligations of the parties and the Minister’s consent. Upon receipt of an application and assessment of the supporting documentation, the deed will be drafted and provided to the parties for consideration.

Additional lease details


The department will consult Liquor & Gaming NSW for any application to transfer a lease of a licensed premises before undertaking any further assessment.


In order to hold a land base Oyster lease from the Crown you MUST be a bona fide oyster farmer and upload evidence via an Aquaculture Permit under the Fisheries Management Act 1994 and a Food Authority Licence under the Food Regulation 2015 to cultivate and/or harvest oyster (including spat).

  • a corporation in which an individual not ordinarily resident in Australia, a foreign corporation or a foreign government holds a substantial interest; or

Evidence of the future leaseholder's skills, qualifications and work experience to meet the obligations of the lease is required.
