Aboriginal land rights legislation
The Aboriginal Land Rights Act 1983 is important legislation that gives Aboriginal people in NSW land rights. When an Aboriginal land council lodges a land claim, this creates what is called an inchoate (unformed) interest in the land. The full extent of that interest is not known until the claim is investigated and the relevant minister makes a determination.
Visit Aboriginal land rights and native title for more information about the Aboriginal Land Rights Act.
If you are a Crown land manager carrying out significant new works on the land you manage, you should check if there are any undetermined Aboriginal land claims.
You can check this through the Department's Aboriginal Land Claim Investigation Unit. Please contact the department for advice.
