Before you apply

  1. Determine the appropriate planning approval pathway for your development. The size and scale of a development will determine which of the assessment pathways applies. Refer to Planning approval pathways.
  2. Confirm that the correct pathway has been selected with your local council.
  3. If the pathway you have identified is either exempt development or development without consent, confirm with council if you require landowner’s consent from Crown land. If landowner’s consent from Crown Lands is not required, contact Crown Lands to see if a lease, licence or other form of consent would be required instead.
  4. Use the free NSW Planning Portal Spatial Viewer to identify the land, the zoning and related Land Environmental Plan (LEP). Ensure the zoning and LEP allows this kind of development on the land.
  5. Where the development is located on land with a s77a or s77b restriction you could apply to have the restrictions removed before applying for landowner’s consent -
    If the restrictions are not removed landowner’s consent from Crown Lands will be required.
  6. Request a search of the land for any existing Aboriginal land claims with the Office of Registrar.
  7. Prepare the supporting documents you will need to complete the application.

Supporting documentation

  1. Relevant authorities who are a party to this development (e.g. local council, Planning NSW) may request specific documentation from you. At the end of the application you will be required to upload these documents. At a minimum a site plan/floor plan/architect plans/drainage plans and environmental assessments and reports.
  2. Any other documentation that supports your development should also be uploaded at the end of this application.
  3. Comment and/or support from the relevant Aboriginal Land Council when an Aboriginal land claim exists on the land.
  4. Comments and/or support received from the Crown land manager supporting the development, when the land is managed by a Crown land manager.
  5. If you are not the landholder – a signed letter from the landholder authorising you to act on their behalf.

Next steps

  • An application fee applies to applications for landowner’s consent. An invoice will be issued once your application is received. Once the invoice is paid, we will process your application.
  • Go to Fees and applications overview for the current application fee amount.
  • Additional fees may be charged when lengthy status searches are required during the assessment. If this occurs, a quote will be issued and the application placed on hold until the payment is received.
  • A licence or lease from Crown Lands may be required before any works can commence on the land. Once the Development Application is approved, apply to Crown Lands for a licence or lease or a licence can be issued from the Crown land manager where one exists.
