Before you apply

  1. Read the Domestic Waterfront Licences – Guidelines (PDF, 1,446 KB).
  2. Use the Fisheries NSW Spatial Data Portal to determine if the site is eligible for obtaining LOC in accordance with the Domestic Waterfront Strategy. Where the site is orange or unmapped approvals are required from DPI Fisheries and Transport for NSW – Maritime prior to submitting this application.
  3. Determine the appropriate planning approval pathway for your development. Refer to Planning approval pathways.
  4. Confirm that the correct pathway has been selected with your local council.
  5. Use the free NSW Planning Portal Spatial Viewer to identify the land, the zoning and related Land Environmental Plan (LEP). Check the LEP to ensure that the proposal is permissible.
  6. Request a search of the waterway for any existing Aboriginal Land Claims with the Office of Registrar.
  7. Prepare the supporting documents you will need to complete the application.

Note: LOC will not be granted for new domestic waterfront structures where the adjoining foreshore land is reserved Crown land, Crown road or other public land. Refer to the Domestic Waterfront Licences – Guidelines (PDF, 1,446 KB).

Supporting documentation

  1. Identification survey.*
  2. A copy of relevant site plan, architectural plans and/or drawings. The plans must be overlayed on the identification survey** and the environmental assessments and reports.
  3. A letter of no objection from NSW Department of Primary Industries – Fisheries where the site is either mapped orange or unmapped in accordance with the Domestic Waterfront Strategy.
  4. Written approval from Transport for NSW – Maritime where the site is either mapped orange or unmapped in accordance with the Domestic Waterfront Strategy.
  5. Marine habitat survey, if required by council.
  6. Comment and/or support from the relevant Aboriginal Land Council if an Aboriginal land claim exists on the waterway.
  7. If you are not the landholder – a signed letter from the landholder authorising you to act on their behalf.

*The identification survey must meet the following requirements:

  • Be prepared by a Registered Surveyor and drawn to scale.
  • Show the:
    • position of the deed mean high water mark (DMHWM) in relation to the deposited plan boundaries
    • dimensions (length and width) and calculated areas (m2) of all existing structures below the DMHWM, including any reclaimed land or freestanding piles
    • title block, border, scale, key, boundary dimensions, site area, north point and, where applicable, vertical datum and contours
    • distance from the side property boundaries to the existing and proposed structures.

**Site plans must be overlayed on the identification survey and indicate the:

  • location of the proposed development (including extensions or additions to existing structures) in relation to the site boundaries and adjoining development
  • elevations and sections showing the proposed materials, external finishes, and heights
  • calculated areas (m2) and dimensions (length and width) for each proposed structure or reclamation below the deed mean high water mark
  • which structures subject to each type of development consent (e.g. DA, BICA, CDC).
